Marketplace terms · Version 2026-10-19.1
Clear rules for buying and selling.
BenX Marketplace is a brand of Ben X Capital LLC, USA. These rules apply to buyers and sellers using the marketplace. Read the seller or buyer section before accepting. Last updated: 19 October 2026.
1. BenX’s role and responsibilities
BenX provides a marketplace where independent sellers offer goods or services and buyers can use supported crypto payment services when enabled. Unless expressly identified as the seller on a listing, Ben X Capital LLC does not own, manufacture, possess, inspect physically, pack or ship the seller’s goods and is not the seller in the purchase contract.
Sellers are responsible for title, authenticity, safety, legality, condition, accurate descriptions, packaging, fulfilment and applicable product warranties. A listing review is a moderation decision based on available information. Approval is not a certification of legality, authenticity, quality, ownership or safety, and does not transfer the seller’s obligations to BenX.
To the extent permitted by applicable law, BenX does not warrant third-party goods and is not responsible for a seller’s misdescription, counterfeit goods, undisclosed damage or failure to fulfil. This allocation does not exclude liability that cannot lawfully be excluded, BenX’s own fraud or wilful misconduct, or any mandatory consumer rights or duties. These terms do not promise that BenX has no responsibility in every circumstance.
2. Seller terms and declaration
You must be at least 18 and legally able to enter a contract, provide truthful account details, own the item or hold authority to sell it, and obtain required licences, registrations and permissions. Your listing and transaction must be lawful in the relevant origin and destination countries. Do not offer an item you cannot lawfully deliver.
Use your own accurate photographs or images you have permission to use. Identify the brand, model, actual condition, included parts, defects, damage, repairs and limitations. Do not conceal faults, claim unverified authenticity, sell replicas as genuine, use misleading prices or make unsupported safety or medical claims. BenX may request proof of ownership, authenticity, compliance or permission before approval.
Every submission requires acceptance of the current seller terms and prohibited-items rules. Submitted listings remain hidden until approved. Editing a submitted or approved listing requires a new review. BenX may reject or remove listings, seek further evidence, and restrict accounts for breaches; publication does not guarantee future approval.
You provide a shipping quote for the buyer to accept before payment. You pay the courier upfront from your own funds. The buyer’s item payment and agreed shipping reimbursement remain in escrow until the applicable release conditions are met. The agreed BenX sale fee is 1% of the item amount, deducted from seller proceeds on release; shipping reimbursement has no BenX sale fee. Standard listings are free. An optional promotion must be separately priced, agreed and marked as sponsored before charging.
Dispatch within the agreed time, use appropriate packaging and the agreed service, and provide valid tracking for every package. Never use another order’s tracking or mark an unshipped order as delivered. Resolve substantiated claims for counterfeit, unsafe, damaged, missing or materially misdescribed goods and comply with applicable refund, return and warranty obligations. Shipping is not automatically non-refundable in every case.
To the extent permitted by law, you must reimburse BenX for reasonable losses and third-party claims caused by your unlawful listing, infringement, fraud or breach of these terms. This does not transfer responsibility for BenX’s own conduct or override mandatory law.
3. Buyer terms and checkout acceptance
You must be at least 18 and legally able to contract. Provide an accurate delivery address, review the seller, description, condition, defects, shipping quote, delivery estimate and applicable return terms, and ask questions before approving a purchase. Do not place fraudulent orders, misuse disputes or falsely confirm or deny delivery.
Before payment, review the exact item price, approved shipping charge, taxes or duties where applicable, payment asset, network, conversion rate, costs and quote expiry. A browsing price in another crypto is an estimate, not a payment quote. A 0.5% conversion margin is included in a conversion quote when an exchange is required; direct USDT on the matching settlement network has no BenX conversion margin. Provider and network charges, if any, must be disclosed before approval.
When enabled, the item amount plus approved shipping are held in USDT escrow. The seller pays the courier upfront. Confirm receipt only after receiving and checking the goods; confirmation authorizes release of both item and shipping amounts. For shipped physical goods, the agreed automatic-release process uses a 24-hour dispute window after independent delivery verification and buyer notification for all packages. Report a problem before release to stop automatic release. Digital goods, services, vehicles and collection require their stated separate acceptance rules.
The operational 24-hour window does not waive mandatory legal rights or statutory remedies. A refund or dispute depends on evidence, applicable law and the order’s agreed terms. Crypto transfers may be difficult to reverse; verify the final asset, network, destination and amount in your wallet. Never disclose a seed phrase or private key to BenX, a seller or support staff.
You must actively tick the buyer terms checkbox before final checkout approval. An unchecked or preselected box is not acceptance. Accepting terms in a preview does not create an order or authorize payment. Checkout remains unavailable until its live payment and delivery integrations are enabled.
4. Prohibited and restricted items
Do not list illegal, stolen, counterfeit, recalled or unsafe goods; weapons, ammunition or explosives; controlled drugs or drug paraphernalia; prescription medicines; human remains or body parts; exploitation or abuse material; prohibited wildlife products; stolen data or credentials; malware; or goods and services that infringe another person’s rights.
Alcohol, tobacco and vaping products, hazardous materials, regulated medical products, financial products or money-transfer services, and any other category requiring specialist controls are not permitted unless BenX has expressly enabled that category and verified the required approvals for the relevant transaction. A category appearing in navigation is not permission to sell a restricted item. Vehicles require valid ownership and transfer documentation. A seller must not evade restrictions by changing the category, description or images.
BenX may request supporting documents, refuse a listing where compliance cannot be established, and report suspected unlawful activity where appropriate. Human moderation cannot guarantee that every breach will be detected.
5. Reports, disputes and account action
Report suspected counterfeit, stolen, unsafe or unlawful listings to verification@benx.market. Include the listing link and a description of the concern; do not send wallet secrets. BenX may temporarily hide a listing while investigating and request evidence from the seller. For an order problem, use the order dispute control when available; an email alone must not be assumed to pause an on-chain release.
BenX may restrict abusive or fraudulent activity and preserve relevant records, subject to applicable law. Moderation decisions do not replace courts, regulators or mandatory remedies. Do not arrange off-platform payment to bypass the agreed order protections or BenX fees.
6. Private information and acceptance records
Legal names, home addresses and receiving wallets are not public listing fields. Information necessary to fulfil an order may be shared with its seller and selected delivery provider through the authorized order process. Public blockchains can reveal transaction amounts and wallet addresses; a private marketplace profile does not make blockchain transactions confidential.
BenX records the terms version, account, acceptance time and relevant listing revision or checkout context. New submissions and purchases require the version then presented. A material change to terms must not silently rewrite an already agreed order. These terms supplement applicable law; they do not remove rights or duties that the law does not permit parties to waive.
